These Terms of Service (“Terms”) govern your access to and use of the website at buzzard.pro (the “Site”), operated by Buzzard Pro — the creative innovation studio of WE-Viral (“Buzzard Pro”, “we”, “us” or “our”). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful, personal and business purposes — to learn about our work and to get in touch with us. You agree not to:

• Use the Site in any way that breaches applicable laws or regulations;
• Attempt to gain unauthorised access to, interfere with, or disrupt the Site or its underlying infrastructure;
• Copy, scrape, republish or redistribute Site content except as expressly permitted;
• Introduce malware or any other harmful or malicious code;
• Misrepresent your identity or use the Site to send spam or unsolicited communications.

2. Intellectual property

All content on the Site — including text, design, graphics, logos, the “Buzzard Pro” name and brand, code, animations and case-study material — is owned by Buzzard Pro or its licensors and is protected by intellectual-property laws. Client names, logos and campaign work shown on the Site remain the property of their respective owners and are used for portfolio and identification purposes. You may not use any of this material without our prior written permission.

3. Submissions

If you send us a project brief, message or other information through the Site or by email, you confirm that you are entitled to share it and that it does not infringe the rights of any third party. We treat the contents of your brief as confidential and use it only to respond to your enquiry and prepare a proposal, as described in our Privacy Policy. Please do not send confidential or sensitive material that you do not wish to disclose before a formal engagement is in place.

4. Proposals & engagements

The Site, including any pricing, packages, statistics or examples shown, is provided for general information and does not constitute a binding offer. Any engagement to provide services will be governed by a separate written agreement (such as a proposal, statement of work or master services agreement) signed by both parties. In the event of any conflict, that agreement prevails over these Terms in respect of the services it covers.

5. Disclaimers

The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including as to accuracy, completeness, fitness for a particular purpose or non-infringement. Performance figures and case-study results describe past outcomes for specific clients and are not a promise or guarantee of future results. We do not warrant that the Site will be uninterrupted, secure or error-free.

6. Limitation of liability

To the maximum extent permitted by law, Buzzard Pro and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of (or inability to use) the Site. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

7. Indemnification

You agree to indemnify and hold harmless Buzzard Pro and its team from any claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your misuse of the Site or your breach of these Terms.

8. Third-party links

The Site may contain links to third-party websites and services (for example WhatsApp, Google Maps or email). We do not control and are not responsible for their content, policies or practices. Accessing them is at your own risk.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we handle personal data.

10. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to any separate written agreement between us, you agree that the courts at New Delhi, India shall have exclusive jurisdiction over any dispute arising out of or relating to the Site or these Terms.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows when they were last revised, and your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
